Terms of Use: Purchased or provided surf images/photos

Upon purchase (on ChrisIntheWater.com, Venmo, cash, or any other form of payment), or if provided without payment, of any photos, videos or media, the Client, purchaser, or recipient of such media, agrees to the following:

1. COPYRIGHT: The Photographer retains the copyright ownership of all photos taken or created by the Photographer. The Client/Purchaser may use the photos for personal use only and cannot sell, license, or publish for profit the photos without the Photographer's written consent.

2. DISPLAY OR PROMOTION: The Client/Purchaser may post the photos/media on social media with or without credit. It is agreed that the Photographer may display and use photographs, videos, media, for the Photographers use on social media, internet promotion, and any other commercial/non-commercial purposes.

Terms of Use: Surf photo session (bookings)

1. SESSION: An Agreement constitutes an order for media in the form of digital images, video and/or prints. This contract constitutes full and complete understanding and agreement between the Client and Photographer.

2. SCHEDULING: The Photographer and Client will communicate to identify date and time to schedule session. Communication may be on the phone, via email, social media, or text message, depending on the desired method of communication between the Client and Photographer.

3. FEES: The Client agrees to pay the Photographer for the agreed to media services. The total cost of the session is due no later than the day prior to the scheduled session time. Upon payment, the Photographer reserves the time and date agreed upon with the Client and will not make other reservations for that time and date. An invoice will be provided to the Client with payment instructions.

4. GIFTS: If gifting a surf photography session, the entire cost of the session must be paid when gift is agreed to. Gifted surf sessions are valid for twelve (12) months. Gifted surf sessions are not refundable.

5. CANCELLATION POLICY: Surf photography is dependent of weather and ocean conditions, and it may be necessary to reschedule or cancel a session. If the Client or Photographer needs to cancel the session, they must do so in writing, (e.g. email, text message, etc.), at least one day prior to the booking. The Photographer reserves the right to cancel a session at any time. If the booking is canceled by the Client on the same day as the session, no refund will be issued. If the Photographer cancels, even within the one day period, no charge will be assessed and the cost will be refunded. In the event of a cancellation due to sickness, equipment failure or travel impediments by either party, every effort will be made to reschedule the session for another time that is convenient for both parties at no additional cost.

6. GUARANTEED DELIVERY: The Photographer will provide all usable media, determined by the Photographer, to the Client, within two weeks of the session date. The media will be shared through a private gallery.

7. LIMIT OF LIABILITY: The Photographer is not liable for any damages, losses, or injuries that may occur during the event or session. The Client assumes full responsibility for any damages, losses, or injuries caused by themselves, their equipment, or their guests of the session. Additionally, although care will be taken with the digital files, the Photographer limits any liability for loss, damage, or failure to deliver media for any reason of photographer’s non-performance caused by any force or similar circumstances, equipment failure, theft, accident, or any cause beyond the Photographer’s control.

8. COPYRIGHT: The Photographer retains the copyright ownership of all photos taken during the event or session. The Client may use the photos for personal use only and cannot sell, license, or publish the photos without the Photographer's written consent.

9. STORAGE OF DIGITAL FILES: The Photographer does not guarantee archival of the digital media past a period of six months after the booking shoot date and will not be held responsible if loss occurs. If failure of technology occurs or due to loss by any other means, the six month period is null.

10. DISPLAY OR PROMOTION: It is agreed that the Photographer may display and use photographs, videos, media, from the session for use on social media, internet promotion, and any other commercial/non-commercial purposes by the Photographer.

11. EMPLOYMENT: This contract is not to be construed as an employment agreement in any way. The photographer functions as an independent contractor.

12. GOVERNING LAW: This Contract shall be governed by the laws of the State of Oregon and any disputes arising out of this Contract shall be resolved in accordance with the laws of the State of Oregon.
